What Is Guardianship in Illinois?

Guardianship is a court-based legal relationship where a judge authorizes a responsible person (the guardian) to make decisions for another person (often called the ward) who cannot fully care for themselves or manage their affairs.

Illinois guardianship law is primarily found in the Illinois Probate Act:

Types of Illinois Guardianship We Help With

1) Guardianship of a Minor

This is common when:

  • a parent is unable to care for a child (temporarily or longer-term),
  • a child has been living with relatives and needs legal stability (school/medical decisions),
  • there are safety concerns requiring a structured, court-ordered arrangement.

Important note: If the minor is 14 or older, Illinois law allows the minor to nominate a guardian, subject to court approval.

2) Adult Guardianship (Adults With Disabilities)

Adult guardianship is used when an adult has mental, physical, or adaptive limitations that prevent safe decision-making.

Illinois law emphasizes a critical principle: guardianship should be ordered only to the extent necessary based on the person’s actual limitations (a “least restrictive” approach).

3) Short-Term Guardianship (Often Used for Minors)

Illinois law also allows a parent (in many situations) to appoint a short-term guardian in writing without court approval, often used during travel, illness, deployment, or emergencies.

A short-term guardian’s authority can be time-limited and, under Illinois law, cannot exceed 365 days

Guardianship vs. Alternatives: Choosing the Least Disruptive Option

Not every situation needs full guardianship. Part of our “Thinking Attorney” approach is confirming whether a less restrictive tool could protect your loved one, such as:

  • powers of attorney (healthcare/financial),
  • supported decision-making arrangements,
  • trust/representative payee solutions,
  • or a short-term guardian appointment for a minor (when appropriate).

We help you select the option that fits your family’s reality and reduces long-term conflict.

Illinois Guardianship Process: What to Expect (High-Level)

While details vary by county and case type, most guardianship matters involve:

  1. Choosing the correct guardianship type (minor vs. adult; person vs. estate; limited vs. plenary where applicable)
  2. Preparing the petition and supporting documents (the “why,” the facts, and the proposed plan)
  3. Notice to interested parties as required by law (this step is often where DIY cases stall)
  4. Court hearing and entry of an order if the statutory standards are met
  5. Ongoing duties and reporting, depending on the type of guardianship (especially when finances/estate issues are involved)

Our role: we build a court-ready filing package, reduce delays, and help you present the clearest, most protective plan possible.

Common Guardianship Problems We Help Solve

Guardianship is rarely “just forms.” We often help clients navigate:

  • Family disagreements about who should serve as guardian
  • Emergency needs for temporary stability (school/medical authority)
  • Complex parenting history, absent parents, or disputed consent issues (minor cases)
  • Adult cases involving safety concerns, exploitation risk, or healthcare access
  • Clear limits on authority so guardianship is not broader than necessary (adult cases)

The Johnson Law Group North Star Approach

Guardianship should create stability, not more turmoil. We help you:

  • Map the cleanest legal path (guardianship vs. alternatives)
  • Prepare strong, organized documentation for court
  • Communicate clearly with family members when possible to reduce conflict
  • Move efficiently through court with an evidence-driven plan

FAQs: Illinois Guardianship

What’s the difference between guardianship of a minor and adult guardianship?

Minor guardianship is under Article XI; adult guardianship for adults with disabilities is under Article XIa.

Can a child choose their guardian in Illinois?

A minor 14 or older may nominate a guardian, but the court must approve the nomination.

What is a short-term guardian in Illinois?

It’s a written appointment a parent can often make without court involvement for temporary care. The authority can be limited and cannot exceed 365 days.

Does adult guardianship have to be “all or nothing”?

Not necessarily. Illinois law directs that guardianship should be ordered only to the extent necessary based on actual limitations.
